Content Takedown Policy

VITADIGITAL LTD operates the Premium NFT marketplace with a commitment to maintaining a safe, lawful, and respectful environment. This Takedown Policy outlines the process for reporting and removing content that violates our Terms and Conditions, applicable law, or community standards.

This policy supplements our DMCA & Copyright Policy, which specifically addresses copyright infringement notices. For copyright-related takedown requests, please refer to that policy.

1. Content Subject to Takedown

We may remove, delist, or restrict access to content on the Platform when it:

• Violates our Terms and Conditions;
• Contains, promotes, or depicts child sexual abuse material (CSAM) — zero tolerance, immediately reported to authorities;
• Depicts, glorifies, or facilitates violence, terrorism, or hate crimes;
• Constitutes defamation, harassment, or targeted threats against identifiable individuals;
• Is fraudulent, deceptive, or impersonates another person or entity;
• Violates applicable laws in the Republic of Cyprus or the European Union;
• Infringes third-party intellectual property rights (see our DMCA Policy);
• Includes non-consensual intimate imagery or privacy violations.

2. How to Submit a Takedown Request

To request removal of content that falls into one of the above categories, send a written request to our Trust & Safety team. Your request should include:

• Your full name and contact information;
• A clear description of the content you are reporting and why you believe it violates our policies or the law;
• The direct URL(s) to the content on the Platform;
• Any supporting evidence (e.g., screenshots, legal orders, prior correspondence);
• A statement that the information provided is accurate to the best of your knowledge;
• Your relationship to the affected party (e.g., rights holder, subject of content, legal representative).

3. Our Review Process

Upon receipt of a takedown request, we will:

• Acknowledge receipt within 2 business days;
• Review the request against our policies and applicable law;
• Take appropriate action (removal, restriction, or rejection) within 10 business days for standard cases, or within 24 hours for emergency situations involving imminent harm or CSAM;
• Notify you of the outcome and the actions taken.

Where the request requires legal analysis or involves jurisdiction-specific law, review may take longer. We will communicate expected timelines in such cases.

4. Urgent & Emergency Requests

If you believe content on the Platform poses an immediate risk of serious harm — including but not limited to CSAM, imminent threats of violence, or content facilitating an active crime — mark your email subject line as URGENT. We will prioritise review of clearly urgent requests and action them within 24 hours where technically feasible.

5. Confidentiality

We treat all takedown requests with confidentiality. We will not share your personal details with third parties other than as required by law, except that we may notify the user whose content was actioned without disclosing your identity, depending on the nature of the request.

6. Appeals

Users whose content has been removed may appeal the decision by contacting us at trust@pnmarketplace.com with the subject line Appeal — Takedown Decision. Appeals must be submitted within 14 days of the removal notice. We will review appeals on a case-by-case basis and provide a final decision within 10 business days.

7. Law Enforcement Requests

We cooperate with legitimate law-enforcement requests from competent authorities in the Republic of Cyprus and other jurisdictions where legally required. Law enforcement requests should be directed to legal@pnmarketplace.com.

8. Misuse of This Policy

Submitting false or bad-faith takedown requests is prohibited and may expose you to liability. We reserve the right to take legal action against parties who abuse this policy to suppress legitimate content.
