VITADIGITAL LTD ("we", "us", or "our") respects intellectual property rights and expects users of the Premium NFT marketplace ("Platform") to do the same. This policy governs the receipt and handling of notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and applicable EU copyright directives.
We will respond promptly to valid notices of copyright infringement. Upon receiving a valid DMCA notice, we will take appropriate action, which may include removing or disabling access to the allegedly infringing content. We maintain a repeat-infringer policy under which we may suspend or permanently terminate access for users who repeatedly infringe third-party intellectual property rights.
If you believe that content available on the Platform infringes your copyright, please send a written notice ("Takedown Notice") to our designated copyright agent at the address below. To be effective, the Takedown Notice must include all of the following:
Incomplete notices may not be actioned. Submitting a false DMCA notice may expose you to liability for damages, costs, and attorney's fees under 17 U.S.C. § 512(f).
If you believe that content you listed on the Platform was removed or disabled as a result of a mistake or misidentification, you may submit a Counter-Notice. A valid Counter-Notice must contain:
Upon receipt of a valid Counter-Notice, we will forward it to the original notifier. If the notifier does not file a court action within 10 business days, we may, in our sole discretion, restore the content.
We maintain a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. A "repeat infringer" is a user who has been the subject of more than one valid Takedown Notice in a 12-month period. We reserve the right to make this determination at our sole discretion and to take action without prior notice where we deem it necessary to protect rights holders.
Please note that NFTs are recorded on the Polygon blockchain, which is immutable. While we can remove infringing content from our Platform's display and disable associated listings, we cannot delete or alter the underlying on-chain token record. Our takedown actions are therefore limited to our own Platform's interface and database.
